Yea, that's one of the biggest problems with cultures of law. There is one law for all, and even though the state cannot actually protect people it will prosecute those who protect themselves.
If law were to be made with actual justice in mind it should be very mindful and considerate of people who commit heinous acts in order to protect themselves from a predator.
